2. ACCEPTANCE OF TERMS
This is a legally binding agreement between:

VASUKUTUMB (Proprietorship Firm), owner of THESARTHY.com (“we”, “our”, “platform”).
By accessing or using THESARTHY.com (website, mobile, or any other medium), you agree to be bound by these Terms.

3. ELIGIBILITY

4. NATURE OF SERVICES (INTERMEDIARY STATUS)
THESARTHY.com is an online classified and information platform that connects users with service providers (including but not limited to repair services, doctors, hospitals, beauty services, and other local services).
We act solely as an intermediary under the Information Technology Act, 2000.
We do not initiate, control, or conclude transactions.
We do not verify all listings, users, or credentials
We do not guarantee quality, accuracy, legality, or authenticity of services
THESARTHY.com complies with applicable provisions of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We observe due diligence and reserve the right to remove or disable access to unlawful content upon actual knowledge or notification by authorities.
We do not verify professional licenses (including doctors, hospitals, or other regulated service providers). Users must independently verify credentials before availing services.

5. NO AGENCY OR PARTNERSHIP
Nothing in these Terms shall create any partnership, joint venture, agency, or employment relationship between THESARTHY.com and any user, service provider, or third party.

6. CHANGES TO TERMS
We may modify these Terms at any time. Updated Terms will be effective upon posting. Continued use constitutes acceptance of updated Terms.

7. USE OF PLATFORM
All content including text, images, graphics, videos, listings, and advertisements (“Materials”) is provided for personal and non-commercial use only.
You agree NOT to:

Create competing platforms
Send spam or unsolicited communications
Misuse platform data
Use bots, crawlers, or automated systems

8. USER RESPONSIBILITIES

Fraud or misrepresentation
Service quality or delivery
Disputes between users Users must independently verify all information before engaging.

10. PAYMENTS DISCLAIMER
THESARTHY.com does not process or control payments unless explicitly stated.
Any payment made is at your own risk. Users are advised to avoid advance payments without proper verification.
If payment services are introduced in the future, additional terms may apply. The platform may use third-party payment gateways and shall not be liable for their failures.

11. USER CONTENT & LICENSE
By submitting content (listings, reviews, comments), you grant VASUKUTUMB a:
Non-exclusive
Worldwide
Royalty-free
Perpetual license To use, display, modify, and promote such content.
Personal data remains protected under the Privacy Policy.

12. REVIEWS, RATINGS & COMMENTS POLICY
Users may post reviews based on genuine experiences.
You must not post content that is:
Fake or misleading
Defamatory or abusive
Illegal or harmful

May remove or modify content
May display user identity if required by law
We are not responsible for user-generated content.

13. INTELLECTUAL PROPERTY
All platform content, logos, trademarks, and materials belong to VASUKUTUMB or respective owners and is protected by law
Unauthorized use, reproduction, or distribution is strictly prohibited.

14. INFRINGEMENT & TAKEDOWN
If you believe any content violates your rights, you may contact us with details.
We reserve the right to:
Remove content
Suspend users
Block access
Without prior notice upon violation.

15. PRIVACY

Users shall NOT give/submit/post listings related to:
Illegal goods or services
Drugs, narcotics, or banned substances
Weapons, explosives, or hazardous materials
Human trafficking or escort services
Gambling/betting where prohibited
Fake documents or counterfeit goods
Unlicensed medical or regulated services
Any activity violating Indian law

 26. INDEMNITY
You agree to indemnify and hold harmless VASUKUTUMB, its owner, employees, and affiliates from any claims, damages, losses, liabilities, or expenses arising out of:
Your use of the platform
Violation of these Terms
Infringement of any rights
Disputes with other users

 27. CONTENT MONITORING & REMOVAL
We reserve the right (but not obligation) to monitor, review, and remove any content at our discretion without prior notice.

28. DATA RETENTION
We may retain user data and content as required for legal compliance, dispute resolution, and enforcement of agreements.

29. PLATFORM AVAILABILITY
